01. Personal Injury Protection (PIP)

Massachusetts is a no-fault auto insurance state. PIP generally pays up to $8,000 toward medical bills and lost wages after a car accident, regardless of who caused it.

02. Three-year deadline

Most personal injury lawsuits must be filed within three years of the injury (M.G.L. c. 260, § 2A). Claims against public entities can have much shorter notice deadlines.

03. Comparative fault

You can recover damages as long as you were not more at fault than the other party (51% rule), but your award is reduced by your share of fault (M.G.L. c. 231, § 85).

Pain and suffering threshold

After a car accident, a claim for pain and suffering generally requires over $2,000 in reasonable medical expenses or certain serious injuries (M.G.L. c. 231, § 6D).

How much does it cost to hire you?

Personal injury cases are generally handled on a contingency fee, meaning the fee is a percentage of the recovery and is set out in a written agreement before we begin. We explain fees and case costs at the first meeting.

What is my case worth?

Every case is different. Value depends on the injury, medical treatment, lost income, long-term effects, insurance coverage and liability. We will not guess at a number before reviewing the facts, but we will explain how value is evaluated.

Should I talk to the other driver’s insurance company?

You should report the accident to your own insurer, but be cautious with the other driver’s insurer. Adjusters may ask for recorded statements or broad medical authorizations. Speak with a lawyer first.

I was partly at fault. Can I still recover?

Often, yes. Under Massachusetts’ comparative negligence rule, you may recover if you were not more than 50% at fault, with your award reduced by your percentage of fault.
